Spring Touch Lawn & Pest Control, Inc. is committed to providing the highest quality service. If you are not completely satisfied with the results of any treatment and are signed up for a 5 or 6 application program, simply notify us within 15 days and we will perform a service call at no extra cost to you.  We also offer a free application within those 15 days for customers signed up for 5 or 6 application program, but do not refund an application price.  We do not offer a money back guarantee.  Spring Touch Lawn & Pest Control, Inc. makes no warranty, express or implied, about the safety of our products used for the control of weeds, insects, diseases, or fertilizers which may be used. All control products used by Spring Touch Lawn & Pest Control, Inc. are E.P.A. registered, have passed extensive product testing and are applied according to label directions following all federal and state laws by state certified, trained Spring Touch Lawn & Pest Control, Inc. technicians.

 

STANDARD TERMS AND CONDITIONS

Procedures, materials, rates of application and timing of applications will be determined solely by Spring Touch Lawn & Pest Control, Inc.  Spring Touch Lawn & Pest Control, Inc. agrees to furnish labor and materials and is authorized by you to treat the property at the address shown on the service agreement or confirmation letter.

 

CHARGES, PAYMENTS AND ADJUSTMENTS

Spring Touch Lawn & Pest Control, Inc. reserves the right to terminate or temporarily suspend this agreement if you fail to make payment when due. A late service fee equal to 0.5% of the outstanding balance per month will be charged on any balance unpaid over thirty (30) days. A service charge of $25.00 will be charged for any returned check. Refunds are computed by subtracting the regular price of any completed services from the original prepay amount, less a $35.00 processing fee. Spring Touch Lawn & Pest Control, Inc. may elect to impose a surcharge to your account due to uncontrollable cost increases from fertilizer or fuel.  If you are a new customer and receive the first application for free and cancel before all applications are completed, you will be charged for the first application.

 

PROMOTIONAL DISCOUNTS

Promotional Discounts are based upon the customer signing up for a full program and taking all remaining program applications that the discounts are originally based upon. Customers that cancel before receiving all services will be charged the full value of these discounts.

 

AUTOMATIC CONTINUOUS SERVICE

This agreement will remain in force for a period of one year and will be renewed automatically for successive one-year terms thereafter.  You will receive prior written notice in January, February and March of such renewal together with any program changes or price increases. This agreement may be cancelled at any time by either party by written notice, for any reason; payment for all work provided prior to cancellation will be immediately due.

By signing up for services, you are agreeing to be contacted by mail, phone, or text messages.  Communication preferences can be updated anytime.

 

TIMING OF TREATMENTS

Spring Touch Lawn & Pest Control, Inc. is responsible for scheduling your lawn for timely treatment. Treatments are generally made at (approximately four to seven week) intervals for lawn or tree and shrub care. Pest control treatments may be monthly, bi-monthly, or quarterly.

 

WEATHER CONDITION CLAUSE

These regularly scheduled programs can be modified with product change depending on the weather and the conditions of your lawn. The success of this program depends on proper watering, mowing, and cultural practices. If you need assistance, please call our office. If it rains after treatment, please wait 7 days before scheduling a respray.

 

SERVICE CALLS

Spring Touch Lawn & Pest Control, Inc. is committed to working with you to achieve expected results. If an issue arises or you believe that a treatment was ineffective, call our office at (507) 934-5296. We will address your concerns at the time of your next regularly scheduled treatment, or if necessary, provide a service call to your property. As results over time are a function of continuous non-interrupted service, any service calls requested by you and performed by Spring Touch Lawn & Pest Control, Inc. during the time of a skipped treatment will be billed at the treatment cost. Additionally, service calls will only be honored for 15 days after the previous application in any instance where the next regular application is not scheduled. Customers with less than four applications per program are not eligible for service calls or free applications. Customers with an unpaid balance over thirty (30) days old will not receive a free service call.

Please note, resprays are a separate application and will not change your scheduled applications.  If a respray is performed, your regular visits may be closer together.

 

INSECT PROBLEMS

Total insect elimination is not desirable, nor achievable, with any program because beneficial insects will be lost along with the target pests. Acceptable levels of activity and targeted applications combine to give enhanced plant aesthetics.

 

BORING INSECT PROBLEMS

Plants invaded by borers have a high probability of death or decline. Sound cultural practices and control applications may extend the life of some species. Treatment of boring insects most often includes additional fees.

 

DISEASE PROBLEMS

Climate conditions and type of disease and plant material affected will impact response. Canker, verticillium wilt and root rot are among uncontrollable diseases which cannot be prevented or controlled by Spring Touch Lawn & Pest Control, Inc.

 

AERATION & SEEDING WARRANTY

Due to the weather conditions, we cannot guarantee the germination of the applied seed. Because we cannot control the weather or how much water is applied to the seed, we cannot guarantee the success of this service. However, the seed we apply has a 90% germination rate with proper watering. Please make sure you are following proper watering instructions.  Spring Touch Lawn & Pest Control, Inc is not responsible for any damage to underground wires or sprinkler systems.  Due to the fact, we do not know where or how deep objects may be underground.  The MN Department of Industry recommends all wire and sprinkler systems to be at a depth of 12 inches.

 

SHALLOW LINES AND/OR WIRES.

Spring Touch Lawn & Pest Control, Inc. is not responsible for damages to any underground lines or wires including, but not limited to, underground dog fencing, cable TV, telephone wires, electric lines, pipes, fixtures, irrigation lines, or any other buried lines, whether marked or not. It is the customer’s responsibility to inform Spring Touch Lawn & Pest Control, Inc. of any underground lines or wires prior to any service on the lawn or landscape. Spring Touch Lawn & Pest Control, Inc. will be responsible for damage to sprinkler heads only if the location is clearly marked prior to service.

 

SPRING TOUCH LAWN & PEST CONTROL, INC. PROGRAMS

Lawn, tree, and pest programs consist of treatments as indicated below and on the service agreement or confirmation letter. Specific products, rates of application, and methods of application may vary with the season, weather conditions, and the specific needs of your property.

 

LAWN: We will apply nutrients, weed control and grub control (round two only) to the lawn for lawn treatments.

LAWN: OPTIONAL SERVICES – Spring/Fall Liquid Aeration or Mechanical Aeration or Spring/Fall Core Aeration with Seeding

LAWN: Landscape beds are not treated due to liability reasons.

LAWN: Disease control for lawn

LAWN: Grub control individual applications, as needed

LAWN: Mole control applications, as needed

LAWN: ANT CONTROL: Six applications

 

PEST: PERIMETER PEST CONTROL- Six applications of exterior perimeter spray.

PEST: MOSQUITO CONTROL- Five applications on the property to control mosquito levels.

PEST: FLEA & TICK CONTROL- Five applications on the property to control flea & tick levels.

PEST: MOSQUITO, FLEA & TICK CONTROL- Five applications on the property to control mosquito, flea & tick levels.

PEST: JAPANESE BEETLE CONTROL - Five applications on the property to control Japanese beetle levels.

SMS Messaging Program

Program Overview:

Spring Touch Lawn & Pest Control operates two SMS messaging programs available to customers who opt in via web forms:

• Non-Marketing / Account & Service Messages: Appointment confirmations, reminders, rescheduling notices, service completion notifications, and account support communications.

• Marketing & Promotional Messages: Special offers, seasonal promotions, discounts, and service updates. Requires separate opt-in consent from non-marketing messages.
   

Opt-In & Consent:

• You will only receive SMS messages in a category if you have explicitly opted in to that category via a dedicated, unchecked checkbox on our web form.

• We maintain timestamped records of all opt-in actions, including the method of consent, the form URL, and the date and time of consent.

• Consent to receive text messages is not a condition of purchasing any goods or services.

• We comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and all applicable federal and state laws.
   

Opt-Out Instructions:

• Reply STOP at any time to cancel SMS messages from that sending number. You will receive a final confirmation message and no further messages will be sent unless you re-opt in.

• Opt-out requests are processed immediately.

• Opting out of marketing messages does not opt you out of non-marketing service messages, and vice versa.
   

Message Frequency & Rates:

• Message frequency varies based on your service activity and appointment schedule.

• Standard message and data rates may apply. Contact your wireless provider for details.

• Carriers are not liable for delayed or undelivered messages.

Supported Carriers:

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.
 

SMS Data Protection Statement:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that support our service delivery (such as SMS platform providers and scheduling software), solely for the purpose of delivering messages you have consented to receive. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Mobile Information Privacy

We respect your privacy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the messaging service.

AI Assistants (Danny the Dandelion & Mark) - Terms of Use

These Terms of Use govern your use of Spring Touch's AI-powered assistants: Danny the Dandelion ("Danny"), our website chatbot, and Mark, our voice bot. By interacting with either assistant, you agree to these terms.

1.  What Danny & Mark Are

Danny is an AI chatbot on our website designed to answer general questions about our lawn care and pest control services. Mark is our AI voice bot available by phone. Neither is a licensed specialist, and their responses are for informational purposes only. For account-specific questions or service confirmations, please contact our team directly.

2. Acceptable Use

You may use Danny and Mark to ask about our services, pricing, and general lawn and pest care. You agree not to:

• Submit false or misleading information

• Send harassing, threatening, or offensive messages

• Attempt to manipulate or exploit the chatbot system

• Use Danny for any unlawful purpose

3. No Guarantee of Accuracy

Danny's and Mark's responses may occasionally be incomplete or imprecise. Spring Touch does not guarantee accuracy and is not liable for decisions made based on their responses. Always confirm important details with a Spring Touch representative.

4. Privacy & Data

Conversations with Danny and Mark — including voice interactions — may be recorded, collected, and used to respond to your inquiries and improve our services. Information you voluntarily share (name, address, contact details) is handled in accordance with our Privacy Policy. We do not sell your personal information.

5. Availability

Danny and Mark may be unavailable at times due to maintenance or technical issues. Spring Touch reserves the right to modify or discontinue either assistant at any time without notice.

6. Intellectual Property

Danny and Mark, including their names, personalities, and underlying technology, are the property of Spring Touch Lawn & Pest Control and may not be reproduced or used for commercial purposes without written consent.

7. Third-Party Technology

Danny and Mark are powered in part by third-party AI and chat platforms. Your conversation data may be processed by these partners in accordance with their own privacy policies.

8. Limitation of Liability

To the fullest extent permitted by law, Spring Touch is not liable for any damages arising from your use of or reliance on Danny or Mark.

9. Governing Lawn

These terms are governed by the laws of the State of Minnesota.

​

10. Changes to These Terms

We may update these terms at any time. Continued use of Danny or Mark after changes are posted constitutes your acceptance of the revised terms.
